In response to an open records request by The Crier, the DeKalb County attorney has confirmed that former Gov. Roy Barnes was hired to contest the state legislation allowing a referendum on a city of Dunwoody and the apportionment of Homestead Option Sales Tax funds.
Barnes, now a trial lawyer in Marietta, was hired last year by the county attorney, William Linkous III.
"You will assist us," Linkous wrote to Barnes on April 27, 2007, "in determining the impact that the City of Dunwoody legislation will have on DeKalb County and with follow up litigation opposing HB 264."
"I'm disappointed but not surprised," said state Sen. Dan Weber (R-Dunwoody) Monday. "Nothing DeKalb does surprises me."
Barnes will bill the county at a rate of $473.33 per hour. His associates will be billed at $233.33 per hour, with paralegals, law clerks and other researchers to be billed at their regular rate, but not more than $95.00 per hour.
"I am very disturbed that CEO Jones has concealed this information
until now," Commissioner Elaine Boyer said Monday. "It has been the trademark of Jones' administration to take matters into his own hands without commission knowledge or approval. DeKalb County needs full disclosure of these types of action since it is the taxpayers monies that he is so freely spending."
If a suit is to be filed, it would be the taxpayers of DeKalb suing the state of Georgia, not the residents of Dunwoody.
At the time of Barnes' hiring, the bill allowing a referendum on cityhood had just been defeated in the state House, but HB 264, the distribution of HOST funds to cities including Dunwoody, had passed and become law. The Dunwoody legislation passed this spring and was signed into law.
Last month, DeKalb's chief executive, Vernon Jones, took the Board of Commissioners into executive session to discuss litigation. Barnes was at the meeting.
Commissioners aren't allowed to discuss what happens in executive session, but state Rep. Jill Chambers (R-Doraville, Chamblee) had said for months that Barnes would be retained to sue.
The commission was to meet yesterday in another executive session, presumably on whether to authorize litigation.
The county attorney did not respond to The Crier's request for a detailed account of any funds paid to Barnes to date. The agreement with Barnes specifies "conducting research and analysis on the legislation creating the city of Dunwoody."
If Barnes has been paid, the amounts should be public record. If Barnes is to be paid more than $100,000, commission approval is required.
In a companion open records request, The Crier asked for details of all contracts and payments under $100,000 authorized by Jones. Linkous responded by mail Thursday that "the county does have documents responsive to your request and will produce the documents."
Linkous said he would notify the newspaper of the cost of reproducing the documents or allow a reporter to inspect them and decide what to copy.
Barnes did not return a phone call for comment.
